These Terms of Service ("Terms") govern your access to and use of the website thesecondstep.net (the "Website") and your purchase of online courses and related digital content ("Courses") made available on the Website. The Website and the Courses are operated by Studio DR sp. z o.o., a limited liability company registered in Poland under KRS number 0000112221 (District Court in Bielsko-Biała, 8th Commercial Division of the National Court Register), NIP 548-10-11-757, REGON 070569257, with its registered office at ul. Malinka 65D/2, 43-460 Wisła, Poland ("Studio DR", "we", "us", or "our").
By accessing the Website, creating an account, or placing an Order, you agree to be bound by these Terms. If you do not agree, you must not use the Website or purchase any Course.
These Terms consist of two parts. Part A sets out the general terms of use of the Website. Part B sets out the specific terms that apply to your purchase of paid Courses (the "Terms of Sale"). Where you purchase a paid Course, both Part A and Part B apply to you, and Part B prevails over Part A in the event of any conflict specifically concerning a sale.
PART A — GENERAL TERMS OF USE
"Website" means thesecondstep.net and any subdomains or related applications operated by Studio DR.
"Course" means any online course, learning module, video, text, exercise, or other digital content offered on the Website, whether free or paid.
"Content" means all text, graphics, video, audio, software, and other material made available on the Website, including Courses.
"User / you / your" means any person who accesses the Website.
"Customer" means a User who places an Order for a paid Course.
"Consumer" means a Customer who is a natural person acting for purposes outside their trade, business, craft, or profession, as defined under applicable consumer-protection law.
"Order" means a request to purchase a Course submitted through the Website's checkout process.
"Access" means the ability to view and use purchased Course content through your account on the Website.
You must be at least 18 years old to register for an account, place an Order, or otherwise use the Website. Studio DR sets this age requirement, rather than a lower age that might otherwise be available under general contract law for simple everyday purchases, because of the sensitive subject matter of the Courses and Studio DR's duty of care towards users. Studio DR does not knowingly permit registration or purchases by anyone under 18. If Studio DR becomes aware that an account has been registered, or an Order placed, by a person under 18, it may suspend the account and/or cancel the Order and refund any amount paid, without prejudice to any other rights Studio DR may have.
When you create an account, you must provide accurate information and keep it up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Each account is for one person only.
Studio DR may, acting reasonably, refuse a registration or an Order (for example, where fraud is suspected), without prejudice to your statutory rights as a Consumer.
You agree to use the Website lawfully and for personal, non-commercial, educational purposes only. Without limitation, you must not: reverse-engineer or scrape the Website; circumvent any access or technical protection controls; resell, sublicense, or share your Access with third parties; upload malicious code; infringe any third party's intellectual property or other rights; or impersonate any person or misrepresent your affiliation with any person.
Studio DR may modify, suspend, or discontinue any part of the Website, other than Access already validly purchased (which is governed by Part B, Section 18), and will give reasonable notice where feasible.
All Content, trademarks, logos, and Course materials on the Website are owned by, or licensed to, Studio DR and are protected by Polish and international copyright and other intellectual-property laws.
Subject to your compliance with these Terms and, for paid Courses, payment in full, Studio DR grants you a limited, personal, non-exclusive, non-transferable, revocable license to access and view the Content and any purchased Course for your own personal, non-commercial, educational use.
You must not reproduce, distribute, publicly perform, sublicense, sell, rent, or otherwise make available any Content or Course, in whole or in part, to any third party without Studio DR's prior written consent. Nothing in these Terms transfers ownership of any intellectual-property right to you.
If the Website allows you to submit comments, reviews, forum posts, or similar material ("User Content"), you retain ownership of it but grant Studio DR a worldwide, royalty-free, non-exclusive, sublicensable license to use, reproduce, adapt, and display it in connection with operating and promoting the Website and the Courses.
You represent that you hold all rights necessary to submit your User Content and that it does not infringe any third party's rights or applicable law. Studio DR may remove User Content that breaches these Terms or applicable law, at its discretion.
Courses are provided for general educational and informational purposes. Completing a Course does not guarantee any particular outcome, third-party-recognized qualification, employment result, or level of skill, unless expressly stated otherwise on the relevant Course page. Any certificate of completion issued by Studio DR confirms only that you completed the Course as offered; it is not an accredited qualification unless expressly stated.
Where a Course addresses addiction, or related behavioral or mental-health subjects, it is provided for general educational and informational purposes only. It is not medical, psychological, psychiatric, or therapeutic advice, diagnosis, or treatment, and it does not create a doctor-patient, therapist-client, or other professional-care relationship between you and Studio DR, any instructor, or any other person involved in producing the Course. You should not treat a Course as a substitute for professional medical or psychological advice, diagnosis, or treatment, and you should always seek the guidance of a qualified healthcare professional, licensed addiction-treatment provider, or other appropriate professional with any questions you may have about a medical or psychological condition, including addiction.
If you or someone you know is in crisis, experiencing a medical or psychiatric emergency, or at risk of harm, please contact your local emergency services number, a crisis helpline in your country, or another appropriate emergency service immediately. The Website and the Courses are not designed or intended for use in an emergency, and Studio DR does not provide, and is not able to provide, emergency support or crisis intervention.
The Website may link to, or integrate, third-party services (for example, payment processors, video hosting, or analytics providers). Studio DR is not responsible for the content, policies, or practices of any third party, and your use of third-party services is subject to their own terms.
To the maximum extent permitted by applicable law, Studio DR is not liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, or goodwill, arising out of or relating to your use of the Website or a Course.
Studio DR's total aggregate liability arising out of or relating to a Course will not exceed the amount you paid for that Course in the twelve (12) months preceding the event giving rise to the claim.
Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or any statutory right of a Consumer that cannot be waived (see Part B, Section 21).
You agree to indemnify and hold Studio DR harmless from claims, damages, and reasonable expenses (including legal fees) arising from your breach of these Terms or your misuse of the Website, to the extent permitted by applicable law and without prejudice to your statutory rights as a Consumer.
Studio DR may suspend or terminate your account and Access if you materially breach these Terms (for example, by sharing your credentials, engaging in fraud, or abusive conduct), following notice where reasonably possible.
Termination for breach does not entitle you to a refund for Courses already accessed, without prejudice to your statutory rights under Part B, Section 21. You may close your account at any time by contacting us; this does not affect Orders already validly concluded.
Studio DR may update these Terms from time to time. The version in force when you place an Order governs that specific purchase. Studio DR will notify you of material changes affecting your ongoing use of the Website, via the Website or by e-mail, with reasonable advance notice.
These Terms are governed by the laws of the Republic of Poland, without prejudice to any mandatory consumer-protection provisions of the country in which you, as a Consumer, have your habitual residence, which continue to apply for your benefit in accordance with Regulation (EC) No 593/2008 (Rome I) or equivalent local rules.
Any dispute arising out of or relating to these Terms is subject to the non-exclusive jurisdiction of the competent Polish courts for the seat of Studio DR (Bielsko-Biała), without prejudice to the right of a Consumer resident in the EU to bring or defend proceedings before the courts of their own country of residence, where mandatorily available under Regulation (EU) No 1215/2012 (Brussels I recast) or equivalent local rules.
If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect. These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Studio DR regarding the Website. A failure by Studio DR to enforce any provision is not a waiver of that provision. Studio DR may assign these Terms in connection with a merger, acquisition, or sale of assets, without materially reducing your rights under them.

PART B — TERMS OF SALE (DIGITAL COURSES)
This Part B applies specifically to your purchase of a paid Course (the "Terms of Sale") and supplements Part A. Where you are a Consumer, this Part B is drafted to align with the Polish Act of 30 May 2014 on Consumer Rights (Ustawa o prawach konsumenta), the Polish Civil Code, and applicable EU consumer-protection law, including Directive 2011/83/EU (Consumer Rights Directive) and Directive (EU) 2019/770 (Digital Content and Digital Services Directive), as implemented in Poland.
Course listings on the Website are an invitation for you to make an offer, not a binding offer by Studio DR. By completing the checkout process and submitting your payment details, you make an offer to purchase the selected Course.
Before you submit your Order, the checkout page will let you review and correct it (Course selection, price, and the e-mail address linked to your account).
The sales contract is concluded when Studio DR sends you an Order confirmation e-mail accepting your Order. Studio DR may decline an Order before that point (for example, in the case of suspected fraud, a pricing error, or a technical error); if it does, you will be notified and any payment already taken will be refunded.
These Terms are currently available in English only, and the Website is presently offered in English only.
Prices are displayed on the relevant Course page primarily in United States Dollars (USD). Depending on your location, our payment processor may also display, or let you choose, the price in Euro (EUR) or another local currency. Where required by law, the displayed price is inclusive of value added tax (VAT) charged at the rate applicable in your country of residence at the time of purchase.
Where a currency other than the one used to price the Course is shown or selected at checkout, the applicable exchange rate is determined by our payment processor (or, where relevant, your card issuer) at the time of payment. Studio DR is not responsible for any currency-conversion fees your bank or card issuer may charge you.
Where you are a Consumer located in the EU, Studio DR accounts for VAT on the sale of Courses (as electronically supplied services) through the EU VAT One-Stop-Shop (OSS) scheme, or such other mechanism as required by applicable law.
Payment is processed by our third-party payment service provider, Stripe. Studio DR does not store your full payment card details; your payment is subject to Stripe's own terms and privacy practices.
Full payment is required before Access is granted. If your payment is declined, reversed, or charged back for reasons other than a valid statutory or contractual reason, Studio DR may suspend your Access.
Courses are digital content delivered exclusively in digital form; there is no physical shipment.
Access is granted automatically through your account, ordinarily immediately after Studio DR receives confirmation of successful payment.
“Lifetime access” means Access remains available for as long as Studio DR continues to offer the relevant Course on the Website. If Studio DR decides to discontinue a Course you have already purchased, it will give you at least thirty (30) days' advance notice and will, where reasonably possible, make the Course materials available to you for download, or provide a reasonable equivalent.
You are responsible for having a device, software, and internet connection compatible with the Website's stated technical requirements. Studio DR is not liable for access issues caused by your own equipment or connectivity.
If you are a Consumer, you generally have the right to withdraw from a distance contract within fourteen (14) days of its conclusion, without giving any reason, by sending Studio DR a clear statement to that effect (for example, using the model withdrawal form in Annex 1, or any other clear statement, sent to contact@thesecondstep.net).
If you withdraw within this period, Studio DR will reimburse all payments received from you, without undue delay and in any event within fourteen (14) days of being informed of your decision to withdraw, using the same payment method you used for the original transaction, unless you expressly agree otherwise.
This general right of withdrawal is subject to the waiver described in Section 20 below, which applies where you have consented to immediate performance.
Because Courses are digital content not supplied on a tangible medium, and Access is typically granted immediately on payment, applicable law lets you expressly consent to immediate performance and acknowledge that, by doing so, you lose your right of withdrawal.
Before you complete your purchase, the checkout page will ask you to actively confirm, by ticking a box that is not pre-selected, the following statement: “I request immediate access to this Course and I expressly consent to immediate performance of the contract. I acknowledge that, as a result, I lose my statutory right of withdrawal once Access has been granted to me.”
If you give this consent, your right of withdrawal under Section 19 ends at the moment Access is granted to you. If you do not give this consent, Studio DR will not grant you immediate Access, and your right of withdrawal under Section 19 will apply in the usual way, which may delay when you can begin the Course. Studio DR will confirm your consent to you by e-mail together with the Order confirmation.
The waiver in Section 20 concerns only your right of withdrawal. It does not affect, limit, or waive your separate, mandatory statutory rights regarding the conformity of digital content, which cannot be excluded under applicable law, including as implemented from Directive (EU) 2019/770.
If a Course you purchased is materially defective, does not match its description on the Website, or otherwise does not conform to the contract, you are entitled, in accordance with and subject to applicable law, to request that Studio DR bring the Course into conformity within a reasonable time and without significant inconvenience to you; and, where that is not possible, is not carried out in time, or would cause you significant inconvenience, to a proportionate price reduction or, in the case of material non-conformity, to terminate the contract and receive a refund of the amounts you paid for the non-conforming Course.
To make a claim under this Section, please contact us using the details in Section 24 (Complaints), describing the non-conformity you have experienced.
Except as required by Section 21 above or other mandatory applicable law, once you have given your consent under Section 20 and been granted Access to a Course, Studio DR does not offer refunds for a change of mind, for dissatisfaction unrelated to a conformity issue, for failure to complete the Course, or for failure to achieve a particular result.
If you believe you were charged in error (for example, an accidental duplicate Order), please contact us promptly at contact@thesecondstep.net; Studio DR will review the matter and correct any confirmed error.
Access granted under a paid Order is personal to your account and remains subject to the license terms in Part A, Section 4. Sharing your account credentials, or the Course content itself, with any other person is a material breach of these Terms and may result in suspension of Access without refund, without prejudice to your rights under Sections 19–21 above.
If you have a complaint about a Course or an Order, please contact us at contact@thesecondstep.net, describing the issue and, where relevant, your Order number. Studio DR aims to respond to complaints within fourteen (14) days of receipt.
If you are a Consumer resident in Poland and are not satisfied with our response to your complaint, you may seek assistance from the competent Powiatowy/Miejski Rzecznik Konsumentów (municipal or district consumer ombudsman) or the Wojewódzki Inspektorat Inspekcji Handlowej (Provincial Trade Inspectorate) competent for the seat of Studio DR, or refer the dispute to the Permanent Consumer Arbitration Court operating alongside that Inspectorate, subject to Studio DR's agreement to participate in that specific proceeding.
Please note that the European Commission's former Online Dispute Resolution (ODR) platform ceased operation on 20 July 2025. If you are a Consumer resident in another EU country, you may contact the consumer-protection or alternative dispute resolution body competent in your own country of residence; the European Commission maintains updated information on national consumer-redress bodies.
Participating in out-of-court dispute resolution is voluntary for Studio DR unless otherwise required by mandatory law.
Studio DR is not liable for any failure or delay in performance to the extent caused by circumstances beyond its reasonable control, including internet or hosting outages, power failures, cyberattacks, or acts of government, provided Studio DR uses reasonable efforts to resume performance as soon as reasonably possible.
